Terms of Participation/Submission Agreement
PLEASE READ CAREFULLY. THESE TERMS OF PARTICIPATION/SUBMISSION AGREEMENT INCLUDE THE SONY PICTURES ENTERTAINMENT INC. PRIVACY POLICY AND TERMS OF USE ("TERMS OF PARTICIPATION"); IF YOU ("PARTICIPANT") CHECK THE BOX PROVIDED AT THE END OF THE TERMS OF PARTICIPATION AND THEN CLICK THE SUBMIT BUTTON, PARTICIPANT AGREES TO BE BOUND BY THESE TERMS OF PARTICIPATION, WHICH INCLUDE, AMONG OTHER ELEMENTS, PROVISIONS GIVING SONY (AS DEFINED BELOW) BROAD RIGHTS TO USE PARTICIPANT’S MATERIAL (AS DEFINED BELOW), PARTICIPANT’S AGREEMENT TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION, PARTICIPANT’S WARRANTIES AND REPRESENTATIONS, PARTICIPANT’S AGREEMENT TO INDEMNIFY SONY (AS DEFINED BELOW), AND PARTICIPANT’S BROAD AGREEMENT TO RELEASE SONY (AS DEFINED BELOW) FROM ANY LIABILITY IN CONNECTION WITH PARTICIPANT’S PARTICIPATION IN THE JEOPARDY! EFFECT PROJECT (THE "PROJECT").
TERMS OF SUBMISSION
By submitting your written material, photograph(s) and/or video (collectively "Material"), you agree to abide by these submission terms and conditions of Sony Pictures Television Inc. ("Sony) and its designees which shall be final and binding in all respects relating to this Project, including, without limitation, the Privacy Policy and Terms of Use.
Who Can Submit: You must be 18 years of age at the time of submission of material and a legal resident of the fifty (50) United States, the District of Columbia or Canada.
Material Requirements:
Material can be written material, video or photos (or any combination thereof) to be considered
Material must comply with the below guidelines and restrictions
How to Submit: Beginning September 12, 2017, and running until Sony announces the end of the Project ("Submission Period"), submit or post the Material on either Jeopardy.com, or any of the digital channels utilized by Jeopardy! and your Material may be considered for the Project. Submitting Material as part of this Project does not guarantee that your Material will appear in the Project. All Materials (if any) will be selected and approved by Sony, in its sole and absolute discretion, Sony makes no guarantee that any Material submitted for consideration as part of this Project will be ultimately selected for the Project.
Material Content Guidelines and Restrictions:
The Material must comply with the following restrictions and you represent and warrant the following:
If you are submitting photos or video, please use a photo of yourself. Do not include others unless you have their permission to include them in the Project. If you are submitting a photo depicting a minor, you hereby grant permission for JEOPARDY! to use, record, copy, reproduce, adapt, edit, summarize, copyright, publish, upload, exhibit, distribute, display, webcast, podcast, broadcast, create derivative works from, perform and otherwise exploit in any media, manner, content delivery mechanism or technology, now known or hereinafter devised, throughout the universe in perpetuity your name, photograph, image, likeness, voice, Material and performance in any manner, format or context whatsoever for commercial purposes including in connection with the promotion, advertising and/or publicity of its motion picture without any further compensation to you or additional notification or permission from you or any third party (as stated in “Grant of Rights") and hereby confirm that you are the parent/legal guardian of the minor child(ren) depicted in the attached photo and no additional consents are required for the permission granted herein.
Please only submit photos or video of which you are the sole proprietor or owner. Don’t include others unless you have their express permission. Do not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Do not link to any infringing or unauthorized content or transmit unsolicited advertising materials.
Keep it clean
Material cannot contain references to any alcohol, drug paraphernalia or firearms. Also please refrain from any unlawful, obscene, sexually explicitly or harassing, profane, violent, derogatory, bullying, racially or ethnically or culturally offensive, and lewd references, and do not defame any public figure, celebrity or religion, and do not promote any unsafe or dangerous activity.
No branding or music
Material cannot include any logos or third party branding (such as logos or trademarks) or any materials such as posters or pictures. Material cannot include any music.
Be nice
Don’t defame, misrepresent or make disparaging remarks or gestures about Jeopardy!, Sony Pictures Television, Sony Pictures Entertainment, their products or services or disparage the television Project Jeopardy!, any other television Project, or the television or motion picture industry.
No Personal Stuff
Please do not provide any personal identification or information of yourself or others (such as license plate numbers, names, e-mail addresses, street addresses, and phone numbers)
All Material should be consistent with the positive image and/or good will with which Jeopardy! and Sony wish to associate. All Material should not violate any law, rule or regulation.
Grant of Rights: You hereby irrevocably grant to Sony and its parent, affiliates, successors and assigns the absolute, exclusive, irrevocable and unrestricted right and permission to use, record, copy, reproduce, adapt, edit, summarize, copyright, publish, upload, exhibit, distribute, display, webcast, podcast, broadcast, create derivative works from, perform and otherwise exploit in any media, manner, content delivery mechanism or technology, now known or hereinafter devised, throughout the universe in perpetuity your name, photograph, image, likeness, voice, Material and performance in any manner, format or context whatsoever for commercial purposes including in connection with the promotion, advertising and/or publicity of its motion picture without any further compensation to you or additional notification or permission from you or any third party (such grant of rights referred to as the "License").
General Conditions: By submitting Material, you hereby agree: (i) to irrevocably release, discharge, and agree to indemnify and hold harmless Sony and its parent, affiliates, respective officers, directors, employees, shareholders, agents, representatives, licensees authorized designees ,owners, subsidiaries, successors, assigns, sponsors and licensees (collectively, the "Released Parties") from any and all actions, damages, costs, liabilities, claims, losses and expenses (including reasonable outside attorney's fees and expenses) to which any of the Released Parties may be subject to as a result of or in connection with any claim related to the use of the photo you submitted, including for, injury or death, defamation or for violation, invasion or infringement of any privacy, publicity, personal, copyright infringement, intellectual property or other right whatsoever that you or any other person now have or may ever have from or relating to any of the Released Parties' exercise of their rights under the License and (ii) to the use by Sony and its designees of your name, city and state of residence, image and/or likeness for advertising, publicity, promotional and trade purposes in any and all media, now or hereafter known, in any manner worldwide in perpetuity, without compensation or additional consents from you or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. Such indemnification shall extend to any claim that might be asserted by others against you that also names the Released Parties. Participant hereby agrees that as between Participant and the Released Parties, any materials (offline, online, mobile and/or any other content) produced by any of the Released Parties pursuant to the License, and all intellectual property rights embodied therein, shall be owned solely and exclusively by the Released Parties.
Released Parties are not responsible for lost, late, incomplete, damage, inaccurate, stolen, delayed misdirected, undelivered or garbled Material; or for lost, interrupted or unavailable network, server, Internet Service Provider, website or other connections, availability or accessibility or miscommunications or failed computer satellite telephone or cable transmissions lines or technical failure or jumbled scrambled delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties or other errors or difficulties of any kind where human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Project, including, without limitation, errors or difficulties which may occur in connection with the administration of the Project, the uploading of Material or in any Project-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users tempering hacking or by any equipment or Project associated with or utilized in the Project. Released parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Project. Sony reserves the right at its sole discretion to suspend, modify or terminate the Project at any time and for any reason. Nothing herein will constitute any obligation on Released Parties to make any use of any of the rights granted by Participant hereunder, including any use of the submitted Material.
No Injunctive Relief Remedy: Each Participant understands and agrees that he/she shall under no circumstance have the right to enjoin or restrain the development, production, advertising, promotion, distribution or exploitation of the Project or this website or any Project-related project, or any other production or project of Sony or any of the Released Parties, or the use by any of Sony or the Released Parties of the Material as permitted hereunder.
By submitting the Material, I agree to abide and be bound by these Terms of Participation and the decisions of SPE, which are final and binding.
